In India a Design is granted protection for 10 years which can be renewed further for 5 years. The process of Registration of Designs is comparatively faster than registration of any other IP right in India.
DESIGN
The registration of industrial design under Designs Act, 2000 and corresponding Designs Rule, 2001 recognizes the creation of new and original features of a product in terms of new shape, pattern, ornamentations and composition of lines or colours applied to articles. Design registration protects the aesthetic features and not the technical features of a product.
Registration of Designs gives the owner the right to claim and file for civil remedies in terms of suit of injunction in case of infringement. There are no criminal remedies provided under the Indian Designs Act, 2000.
